Terms for using Manhole Quest and related services.

1. Introduction

Thank you for using Manhole Quest. By accessing, browsing, downloading, installing, or using the Manhole Quest mobile application (the “App”) and any related services provided by emonster, inc. (collectively, the “Services”), you acknowledge that you have read and agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, please discontinue use of the Services immediately.

emonster, inc. (“emonster”, “we”, “our”, or “us”) reserves the right to modify these Terms at any time. We may update the Terms from time to time, and your continued use of the Services after any such update constitutes your acceptance of the revised Terms.

THESE TERMS CONSTITUTE A BINDING AGREEMENT BETWEEN YOU AND EMONSTER.

2. About Manhole Quest

Manhole Quest helps you discover, browse, and collect Japanese manhole covers. The App may provide map, nearby discovery, local weather, camera, photo, scanning, catalog, and collection features depending on your device capabilities and the features you choose to use.

3. Usage License

Subject to your compliance with these Terms, emonster grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the App and to access and use the Services for your personal, non-commercial use.

emonster may suspend or terminate your access to the Services at any time and for any reason, including, without limitation, if you violate these Terms or applicable laws.

4. Eligibility to Use the Services

You must be at least thirteen (13) years of age to use the Services, or the minimum age required in your jurisdiction, whichever is greater. If you are between the minimum age and the age of majority where you live, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the Services, you represent and warrant that:

  • You meet the minimum age requirement above; and
  • Your use of the Services is not prohibited by applicable laws or regulations in your jurisdiction.

5. No Warranty and Limitation of Liability

THE SERVICES, INCLUDING THE APP AND ALL CONTENT AND FEATURES, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EMONSTER DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, INTEGRATION, INTEROPERABILITY, AND QUIET ENJOYMENT.

EMONSTER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. EMONSTER MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR INFORMATION AVAILABLE THROUGH THE SERVICES.

Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. In such cases, any implied warranties are limited to the minimum extent permitted by law.

YOU UNDERSTAND AND AGREE THAT YOU USE THE SERVICES AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM SUCH USE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL EMONSTER BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR IN CONNECTION WITH THE SERVICES; OR
  • UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR DATA.

IN NO EVENT SHALL EMONSTER’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE AMOUNT YOU PAID (IF ANY) TO EMONSTER FOR USE OF THE SERVICES DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such cases, our liability will be limited to the minimum extent permitted by law.

6. Changes to the Services

We may modify, update, or discontinue the Services or any part thereof at any time, temporarily or permanently, with or without notice. This includes, without limitation, changes to features, pricing, availability, supported platforms, or the way certain functions are delivered.

Your continued use of the Services after any changes indicates your acceptance of those changes.

7. Intellectual Property & EMONSTER Content

Manhole Quest, the Manhole Quest application name, product screenshots, and related branding assets are trademarks or the subject of other intellectual property rights of EMONSTER and may not be used without our prior, express written permission (other than reasonable nominative use for attribution).

All content included in or made available through the Services, such as text, graphics, logos, UI design, software, and the compilation of such content, is the property of EMONSTER and/or its licensors (collectively, the “EMONSTER Content”) and is protected by United States and international intellectual property and other laws.

Except as expressly permitted by these Terms or by us in writing, you may not copy, reproduce, transmit, modify, adapt, create derivative works from, distribute, publicly perform, publicly display, or otherwise exploit the EMONSTER Content in any manner.

8. User Feedback and Submissions

If you send us any feedback, ideas, suggestions, bug reports, or other materials (collectively, “Feedback”), you agree that:

  • Your Feedback does not contain confidential or proprietary information of any third party;
  • We are not under any obligation of confidentiality, express or implied, with respect to the Feedback; and
  • You grant EMONSTER a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, copy, modify, translate, adapt, publish, distribute, and otherwise exploit the Feedback for any purpose, without compensation to you.

9. Fees and Purchases

Manhole Quest may be offered as a free download with optional in-app purchases that unlock additional branded collections or related content. All purchases and payments are processed by the Apple App Store (or any other platform from which you obtained the App) and are subject to that platform’s own terms and conditions, including its refund policies.

EMONSTER does not have the ability to manage billing on your behalf (including initiating or refunding purchases). Please contact Apple (or the applicable platform) for any billing or refund questions.

You are responsible for all charges incurred in connection with your device and your use of the Services, including any data charges from your mobile network operator.

10. Prohibited Uses

You agree that you will not, and will not attempt to, do any of the following:

  • Use the Services for any illegal purpose or in violation of any applicable law or regulation;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law;
  • Remove, circumvent, disable, damage or interfere with any security-related features of the Services;
  • Use any robot, spider, scraper or other automated means to access the Services for any purpose without our express written permission;
  • Interfere with or disrupt the operation of the Services or any servers or networks connected to the Services;
  • Upload or distribute viruses, worms, malicious code or any other harmful software through the Services;
  • Infringe or violate the intellectual property or other rights of EMONSTER or any third party;
  • Use the Services to harass, abuse, or harm another person or entity; or
  • Bypass or override any measures we may use to prevent or restrict access to the Services.

11. Third-Party Services and Links

The Services may integrate with or contain links to third-party services, SDKs, or websites (for example, app store services, analytics providers, crash-reporting tools, or support tools). These third parties operate independently from EMONSTER and have their own terms and privacy policies.

We do not control and are not responsible for the content, policies, or practices of any third-party services. Your use of such third-party services is at your own risk.

12. Analytics & Diagnostics

The Services may use third-party analytics and diagnostics tools (for example, Firebase Analytics and Firebase Crashlytics) to help us understand how the App is used, measure performance, and identify technical issues. These tools collect only non-personal, aggregated, or anonymized information and do not identify you individually.

By using the Services, you acknowledge and agree to the processing of such diagnostic and analytics data in accordance with our Privacy Policy.

13. Indemnification

You agree to indemnify, defend, and hold harmless EMONSTER and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  • Your access to or use of the Services;
  • Your violation of these Terms; or
  • Your violation of any rights of any third party.

14. Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the Services will immediately cease.

15. Governing Law and Dispute Resolution

These Terms and your relationship with EMONSTER shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in King County, Washington, and you hereby consent to the personal jurisdiction of such courts.

Some jurisdictions do not allow the choice of governing law or forum in certain circumstances, so the above may not apply to you to the extent prohibited by applicable law.

16. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and EMONSTER’s failure to assert any right under these Terms shall not constitute a waiver of such right.

YOU AND EMONSTER AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN SIX (6) MONTHS AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
